yes ive got the cd in the drive but i burnt it on a windows setup if that makes a difference

Why do you have spaces, at least they look like spaces, in your
sudo sh /media/<device-name>/nvidia-driver-name.pkg.run command?
Specifically, it looks like you have a space between media and /CD and so on, i.e. it looks like /media /cd /NVIDIA...., when it should be /media/CD/NVIDIA....
Just a question, as this does not explain why your optical drive is not mounting under /media.
Another question, if you navigate to / and perform an ls command, does /media even show up?

i did it with and without spaces and the result was the same

what is the content of your /etc/apt/sources.list?
and if you have any, the *.list files in /etc/apt/sources.list.d/

Hi
I very much doubt the current video drivers will support a nvidia mx440...pretty sure the min requirements for xbmc live video is GeForce 6 Series
