Change to refresh rate changer behavior

This may not have been a big issue up until now, but with the Live-TV addition to xbmc the problem becomes much more apparent.

XBMC has a set menu refreshrate, and changes refreshrate when viewing content with other framerates, it's a very nice feature.

The problem is entering menu while watching content, changes the refreshrate back to the set menu refreshrate. This is not very practical, it mess with the video playback, and maybe all you wanted was to quickly check something for a second and then back to fullscreen - this would result in 2 refreshrate changes in matter of seconds. Very frustrating when watching live tv.

Now I know xbmc menu prefer 50 or 60hz, and is not working that great in 24hz.

Mediaportal does this in the following way, it simply stays in the last hz you used until a video require change again. Ofcourse staying in 24hz is bad for performance, so it's not optimal.

Another solution would be to simply lock the refresh for as long as there is video playing, so if you play a 50hz video it's locked to 50hz until it's stopped even if your menu is 60hz.

The best option imo would be the mediaportal approach, but you exclude 24hz, so if you viewed 50hz content the menu stays in 50hz, if you played 60hz it stays 60hz, but if you played 24hz it reverts to 50 or 60hz.
