Ok so i called a buddy of mine and asked him to do the tests for me as i am at work.......
He played a video via windows media player and turned off the tv, it to stopped audio and when he turned it back on media player had a error on it, but the video kept playing until he clicked ok on the error, then it all died.
Next test is to send audio via optical instead of HDMI and see if it makes a difference. Will keep you posted on the tests.

From all that has been reported, these issue all seem to be with the Windows OS and HDMI handshake with devices. I don't know if there is anything XBMC can do about it.

Yeah. Seems like its definately related to the audio side of hdmi. I installed a new creative xfi and im using the optical output on it. This has solved my problem.
Now just need to get the dirty regions fixed for my cpu load.
