I have a mate who has apple tv he has seen my xbmc he like it love it has ask can you put it on the apple tv but he still want to use the apple tv as is

Yes, but the Apple TV needs to be jailbroken. There is currently no jailbreak for ATV 3 - which is why Apple TV 2s are more expensive on eBay. :-)

The I have is black 5.0.2 can that be jail broken

You have to work out whether you have an Apple TV 2 or 3 (I'm assuming it's not an Apple TV 1).

If you have an Apple TV 3 then you'll have to wait for a jailbreak.
