Win NVIDIA stuttering image on 1080P with DXVA enabled

Hi,
I have: intel DQ45CB motherboard with Dual Core 3Ghz processor and Nvidia GT430 graphics running on Win7 pro, XBMC frodo DXVA/DXVA2 enabled + samsung LE37B650 TV connected with HDMI

I have the following problem.
When the resolution of my screen is set to 720P, every movie i throw at XBMC plays fine, no stutters, no picture drops, no audio drops,...
however, if i set the screen to 1080P, DXVA is giving problems => audio runs fine, but the movie stutters, it's like every half second the picture pauses and then starts again.
If I turn off DXVA evrything works fine again, but the processor usage go up to 20~30% and more, with fans that start spinning louder ( wich a wanted to avoid ).
I have the same issue with my XPS L502X laptop with I5 core and integrated intel HD3000 and Nvidia GT540M graphics card and the 720P screen.

So as soon as I cranc the resolution up to 1080P I have this problem.
I'v also changed the refresch freq. from 23HZ up to 60HZ but nothing helps.

Is it Nvidia problem? => Nvidia can't handele high resolutionsHuh
Do I need to set or change some settings in Windows or XBMC?
