oh you da bomb!!! Uninstalled, reboot let it get the driver online reverted to 11/09/2011 amd driver. uninstalled catalyst also. not sure i need it anyways when i did i didn't uninstall hdmi audio driver so kept dts and 8 channel output on the hdmi card...woo hoo i love the xbmc interface out of all the htpc media players i have tried didnt want to lose it thanks for the help...PROBLEM SOLVED!!!
