Linux No HDMI audio option after 13.04 upgrade

XBMCbuntu.
xbmc wsnipex version 2:12.1~git20130319.1943-frodo-0raring.
Arctic MC-001N (ATI Mobility 5430HD)

When I go to audio options in system there is no HDMI option There was under 12.10.

aplay -l
Code:

  Subdevice #0: subdevice #0

So it is detected in aplay but it's not an option in XBMC. Also, I have the "Unsupported hardware" watermark." I read how to remove it but I am thinking for some reason mine really might not be supported.

Any ideas?

I bet thats an AMD driver(fglrx) problem

So what can I do, just wait for a new driver? Audio works under 3.5.0.27. Although now the graphics aren't as smooth as they were before. Also, alsamixer only shows SPDIF as an audio. I disabled onboard audio prior to my initial post to see if that would help.

Don't use 13.04 for now. The fglrx driver is bad and xbmc will have 100% load with vsync turned on always.
First decide what functions / features you expect from a system. Then decide for the hardware. Don't waste your money on crap.
