First try, if: Fixed with 48000 works.
First decide what functions / features you expect from a system. Then decide for the hardware. Don't waste your money on crap.

I tried it, (download sources and modify the files mention in the patch and compile kodi myself). But it looks like the problem is not solved, still same behaviour (fixed output -> sound, best match/optimized with or without paththrough -> no sound)

Do you have any idea how I can verify that the patch is implemented correctly, how can I debug or troubleshoot my problem futher?

If sound works correctly with 48 khz, then you know that your AVR does not eat 44.1 khz.

Try that first: Go to settings and set your refreshrate to 30hz, disable Adjust Refreshrate to match video.

Does sound (including menu sounds) work now, also with Optimal setting?

For me it seems working. Here are my settings:
Video Output->
- Display Mode: Full screen
- Resolution: 1920x1080p
- Refreshrate: 30.00
- Blank other display: off
- Steroscopie: 3D mode same as movie
- vertical blank sync: enabled during video playback

Audio Output->
- Number of channels: 5.1
- Output configuration: Fixed
- Limit sampling rate: 96 kHz (I also test the thouthers without any problem - in fixed mode)
- Stereo upmix: on
- Resample quality: Medium
- keep audio device alive: 1Minute
- Play gui sound: only when playback stopped

Video settings -> playback:
- prefered audio language: Original stream's language
- Play the nex video automatically: off
- Adjust display refresh rate to match video: off
- Sync playback to display: off
- allow error in aspect ratio to minimise black bars: None
...
- Playback mode of stereoscopie 3D videos:on
- Disable strereoscopic 3D mode when palyback ended: on

Video Settings -> Acceleration
- Render method: Auto detect
- Enable HQ Scalers for scalings above: 0%
- Decode methode: Hardware accelerated
- Allow hardware acceleration (VDPAU): on
- Prefer VDPAU Video Mixer: on

In Fixed mode I did not find any combination from Refresh Rate and Limit sampling rate where the menu sound did not work.

With Audio Output Configuration: Optimal, and Video Refresh Rate 30.0 sound will also work, if I put it to >30 (like 50.0) I will losing the menu sound. So you are right with your theory, it seems to be the known AVR/intel bug...
