Win Random change frame rate during playback

Hello Everyone!

If i watch 24p movies, Kodi change the framerate when video starts to 24hz, thats fine.
Randomly, after 1-3 mins its switch back to 60 hz and sometimes after couple of mins switch back to 50 hz or what he wants.

I use real full screen mode, and framrate set to video option. playback is on ati 4850
I came from XBMC with automata settings convert, but i also tried a clean install and same result.
I used Kodi couple of times after convert, but today its strange and i dont know what the problem is.
(computer restart and stuff i did to close out not my machine is the problem).
Any idea?

at 11:15 i started the video "Defiance"

I also recorded to video with my phone.
normal working, i checked on my TV that 24hz (0:29) , than flash (0:43), menu for a moment, the the subtitle more wide (0:49), and checked on the TV to 60hz (0:55)... sometimes later 50hz etc.

does it only happen at this episode ?
looking at the log it looks like the mkv is faulty (i'm no expert just trying to help out)
could you try another serie or episode ?

Yes, and the previous one. But to be honest after this i didnt watch more (it was yesterday night)
i leave like this and today will watch different movie....we will see, i'll feedback to you.
Is there a chance (a program maybe) to verify the mkv?

Today, i used Kodi for watching movies and series, no problem at all.
So i can tell it was a strange MKV problem.
i checked the mkv compared to other ones and found this:
(mkv parser) warning: pos. 111: Element 73 A4 should be present in SegmentInfo, but wasn't found
