Kodi is open source software. As long as its licence is not violated you can do whatever you want with your software.
Its like having a knife you can either kill someone or spread jam on a slice of bread. Knife manufacturer cannot be held responsible with what you do with your knife.

No you can't literally do anything you like. You must follow the copyright licence. However the licence doesn't prevent use for piracy.
The trade mark licence does forbid you selling piracy boxes under the Kodi trademark though.
