Can I install Kodi 17.1 on Kodi 16.1 that already installed?, or I must have a fresh installation.

You can install over the top. Kodi will try to upgrade everything after it installs.
Just in case, I would highly recommend making a copy of your kodi application data folder before upgrading. That way, if something is disastrously wrong with the upgrade, you can go back to 16.1 using the backup.
