Hi What i am trying to achieve is, a playlist or folder which contains, Unwatched episodes from TV shows that i choose, sorted by airdate.

I have automatic downloads for shows that are currently airing i would like to keep up to date with these as they run on TV

if i create a smart playlist i can choose
"Location - is 'File path;"
and
"play count" less than "0"
items must match all of the rules - Great, for one show. i add a 2nd file path, there's too many rules, and nothing will show.

is there an easy way to do this or a work around? i dont really want to put all the current TV shows in the same folder as i would to keep the "correct" file structure for tv shows.

Use the in-progress shows node (videos -> TV shows -> In progress TV shows) + "hide watched" in the lefthand sidebar menu. It will show all shows that have at least one watched episode and any unwatched episodes, but without showing the unwatched episodes. I use this all the time.
