Are the films claiming to be 4k actually 4k? Unless I'm doing something wrong. Any ideas
Yes, there are actual 4K movies with a 3840×2160 resolution, and there are also 8K videos with an even higher resolution.

But without an actual problem/bug description, we cannot help you any further.

Where are you obtaining the films from?

Judging by your post history, if it's from a banned addon (wiki) then all bets are off and who knows what you may be getting (both in terms of media and what else you may be running or downloading that you're not aware of).
I guess a film can claim to be anything.  There is the concept of "UHD" that tries to specify what is included in a film.  You should be able to see in Kodi's log (with debug logging on) what Kodi (ffmpeg) found in an AV file/stream.
