I had previously posted this and then got into banned mess so I thought I would repost. The stuff at pastbin is a before (mkv) and after conversion (m4k) of the offending video file. The logfile is the same as I sent before as kodi hasn't changed (I don't think).
Its also interesting that after the conversion the file is half the size of the mkv file yet the video resolution seems the same!
In the first version of the offending file the picture is lagging the sound by several seconds. I have also seen it get into sync and then go back again. Its very strange. My current solution is to use handbreak to convert the file to a different - mkv to m4v. The interesting thing is that the same mkv file, played in vlc, remains in sync which tells me that kodi couldn't play the file right.
