I had everything up and running and then decided for a tangental reason, to reinstall ubuntu and start over. Audio was working perfectly before the reinstall (i.e. I know that it ultimately works). I just can't get audio to work in XBMC now. Audio is find outside of XBMC.
I am running audio through on board HDMI (GIGABYTE GA-E7AUM-DS2H) to a receiver. When I start a movie I get an error that the audio hardware failed to initalize.

as always, any help could be greatly apreciated. I am sure I am overlooking something minor, I just cant figure it out.
