hello would it be possible to allow the option to disable the mouse from the skin.xml this would stop people from using the mouse with skins that do not supported the use of the mouse reducing crashing or problems that people run in to.

Nope - crashing is something we should fix in XBMC.

If the skin doesn't work well with the mouse then you can replace the default mouse icon such as is done in Ellipse to inform the user of this.
