Ubuntu, the system that XBMC Live runs on, has traditionally been an open source system. This will be changing soon. The new owners of Ubuntu are allowing closed source software in.
Ubuntu has thrived as an open source forum for benefeit of the community. While the initial introduction is adding closed source software to the distribution packages, eventually it may change. This change will allow people to charge for linux software eventually.
Anyone notice the "get free software" icons? I think this is a master plan to make money by the new people in charge of Ubuntu.
