I was thinking, it shouldn't be too difficult to stop the worst of offenders, when they are using the word "Kodi" in their business name, it is direct trademark infringement to the highest degree and without even needing to question content, shouldn't be too difficult to get taken down. Enough with this madness, let's all do our part and get complaining!

Domain Name: In terms of trademark infringing domain names, the arbitration process seems to be quite simple actually. It is important to note that the domains below aren't simply squatting on domain names, they are actively associating Kodi with piracy through their domain name, and thus causing major damage to the Kodi brand. It would be quite simple for the XBMC Foundation to commence the ICANN dispute resolution process, both the ADR and WIPO provide arbitration forums at a simple cost, it actually wouldn't cost that much when it comes down to the number of offending domain names. Once a decision is reached, the offending domain name would be transferred directly to the XBMC Foundation.

Twitter generally follows American law, so they definitely don't want pirates killing a legitimate organization's trademark. Hopefully they'll listen if enough of us complain!

Apparently facebook only accepts complains coming from someone acting on behalf of the trademark owners (agent, lawyer,etc) so I guess not much can be done by any regular user.
If anything can be done by us, I am in.

There is a company where I live called Movienight.watch they sell google nexus boxes preloaded with kodi but put under a different skin, they sell these boxes for $200 and the box itself goes for about $60. I'm just curious if this is legal and if anyone here is aware of it

Once you get a court order against any of the sites using "Kodi" in their domain name, you can request that Google remove it from search results entirely, a request they generally honor: https://support.google.com/legal/troubleshooter/1114905?rd=1/troubleshooter/1114905?rd=1

To add to that. This forum is now full of "prove" that you have been made aware of A LOT of violators, basically since the US Trademark got through. However up till now, none of those links/sites/shops has been visually taken down.

Or let me put it otherwise. No prove of the Foundation defending the Trademark can be found.

Above I talk about "US Trademark", because last time I checked I have not found any other registrations for other regions. Yeah, some dodgy onces that has been mentioned, where a lot of "yeah our lawyers are working on it claims" have been made on the forums. Yet, they are still there. I really hope you guys do not pay those lawyers by the hour since then Big Grin


Anyhow; To get it clear once and for all, a question to the Foundation (or anyone involved and knows the answer)

For which regions is the Trademark registered?

We are aware of these sites and the ecosystems growing on facebook and twitter too.

Our advice to any "fan" or 3rd party sites is to not use our name or logo.

I checked a few of the sites. Are you sure, these sites are infringing the trademark? I'm no lawyer but the fact that they use the word kodi and offer shady addons does not automatically mean they are infringing your trademark if I'm informed correctly.
