This is (sadly) no bug - this is intentional :/
Reason for that is XBMC - the NFO has to be inside this folder, and then ofcourse named like the video file/folder; else it won't detect it!
So, yes, this is hardcoded and overriding all your settings.
(I'm not sure if this already changed in Kodi - i guess not @see here)
You could try to set the NFO format to MediaPortal - iirc we write that 'the standard way' (tbc)
