Unless my research is inaccurate I dont believe the of viewing of streamed copyright material i.e. movies or tv is illegal as defined by the European Court of Justice and very recently in the German Courts. That does not matter whether it be via Kodi, Plex or another app. the problem arises when you download the media.

I think you're confusing the copy of material being illegal vs the person watching it being prosecutable. The video can still be an "illegal copy" even if the viewer has done nothing wrong.

"Downloading" it doesn't change anything, though. It doesn't make it more or less illegal. The idea that a RAM-only copy of something is legal comes from a situation where the original copy itself is also legal. Computers need to copy data into RAM in order to process it, so most countries make it clear that this type of data copy is not a violation. Some people seem to think that you can legalize a pirated copy by keeping it in RAM, which is absurd.

I will have another look at the legislation but for the moment I accept your point. However how many people have been prosecuted for viewing streamed material? I would suggest very few if any . If it is illegal how on earth do you justify a prosecution of a private individual, its not going to happen, it certainly wouldnt be a public prosecution ie via CPS as they could not justify the cost from the public purse and its probably not in the public interest . Therefore it would be an action by one of the anti piracy organisations and as a matter of policy they dont go afer the small guy as its bad press, but they do threaten. So in my humble submission carry on streaming nothing is going to happen legal or not.

Again, you confuse something being illegal or not with the person being prosecutable or not. They are two different things.

Sorry but I have not confused anything! If an act, or conduct by omission or otherwise is contrary to a law whether it be a parking contravention or murder it is in plain English! Illegal. The natural process for such matters is to proceed to law ie go to Court. Thats whats termed a prosecution. Unless no one wants to prosecute, not enough evidence, not in public interest etc, etc.

If someone strips naked in public, that is illegal (at least in the US). If I happen to watch them, I have not done anything illegal, but it is still accurate to say that stripping in public is illegal. That is the difference. It's not a matter of what the end-user does, but what the status of the video itself is.

I'm not sure how much other gov'ts respect the DMCA, but if they have a similar policy, the DMCA shields websites from copyright and piracy claims if written notice is provided and the offending item is immediately removed. It's basically the same reason Youtube isn't constantly being sued for the efforts of copyright violating uploaders.
