Linux Audio Time Out

So this is an odd issue.

I had a Zbox AD04 running xbmcbuntu 12.1 attached to an LG TV via HDMI my audio worked fine with no audio idle timeout.

I switched that box to a dell E6230 (windows and xbmc 12.2) or something laptop (had a 512 meg nvidia video card in it) I attached it via HDMI and analog headphone jacks tried both and what happens is you walk away for like 10-15min and come back and all of the sudden the audio is either disable or switched over to the PVR box which is attached to the other input on the tv. I figured this might have something to do with the nvidia audio driver on the PC so I updated it tried it in my soundbar and the TV and the same issue.

So now i switched over to a dell I5 in a low profile case running 13.1 and another nvidia cad http://www.staples.com/EVGA-NVIDIA-GeFor..._IM1DX6454 I am still having the same issues. Also I made sure to go under audio options and select keep connection alive always.

Has anyone had this issue before its been driving me nuts?
