So i dont quit kodi but i will go to the shield dashboard, and sometimes when i load it again through the quick access, it will show the loading screen and also load the skin, other times it will resume where i last left

Is that just normal, is there a way to change it?

Is there a shield setting, the OS is android so wouldnt it be an android setting?

No because it'll be the Shield doing memory management. When you exit Kodi the state will be saved in memory and will be kept there until that memory is needed for something else in the foreground, then it will kill the save state to free up memory.
