Well, is there actually anyone out there WITHOUT those vsync errors in the log running ATI Drivers? I now switched to envy-ng ati drivers which installed just fine, direct rendering is enabled but still xbmc.log tells me that vsync is unsupported :-(

Well that's why I am asking if this might be an issue for all ATI users. Maybe most of them never checked xbmc.log.
@
d00chris can you confirm this, please check your xbmc.log for that vertical syncing message.

Alright, small update here on my progress:
I switched to my 8500GT cause I was tired of ATI for tonight ;-) Installed driver via envy-ng.
Disabled flipping in Nvidia Settings and enabled all vsync options.
Result is, that xbmc idles mostly between 7-10%, Sometimes also at 20%, but average I'd say 10%, according to "top".
Tslayer, what usage do you get with your nvidia setup?

Btw, those 10% refer to the cpu running @1000mhz btw. Since Cool'n Quiet is active.

I know that I have Vsync enabled on my machine and that it is indeed supported by the ATI driver. How? Well, if I turn VSync off (using the Catalyst Control Panel), I will get tearing when playing video. If I turn it on, the tearing disappears.

You got a point there man, that's right. Turning vsync on/off in ATI driver did indeed make a difference in video playback regarding tearing. But it seems that XBMC has trouble detecting vsync ... at least that's what the log says ...

You may only be able to do it via ATI and not programmatically. I don't know to be honest.

Just updated to the latest build Sept 17 and now processor is at 100%. Also lost full screen (When I hit the \ key it goes to full screen for a few seconds and then back to showing the upper and lower panels) and lost all audio (Except for the sound clicks moving through the prompts) from music collection. Movie audio AC3 plays fine except for out of sync and being jerky do to processor being maxed out. How do I go back to the another release?

You obviously have some other issues.
I suggest removing everything (including your userdata) and installing again.
