Good news! Thanks to Lord_Pall on IRC, he found a '16bit output' option buried in the ATV2 that seems to fix AC3/DTS Passthrough for the nightly build on 4.3.2.
So all you 4.3.x folks, upgrade to 4.3.2.
In the AppleTV menu, just go to Settings>Audio & Video>Audio Output and change it from "Auto" to "16 bit" (thx DN38416)
In addition I'm happy to report success with AudioEngine builds on ATV2 with AC3/DTS on 4.2.1! OSX is still a little buggy.
Remember if you want to join the AE testing team (and have ac3/dts capabilities) please join #xbmc-ae!

I'm on 4.2.1 and have no problems with dts, other than when downmixing, is there any benefit to upgrading to 4.3.2 at the moment?

I don't often post (I'm more a reader, not a writer here), but I'd like to mention that all works better than before regarding the iOS upgrade and latest nightly. I'm on 4.3.3 (4.2.2, build 2203). I'm now able to play 90% rather than 75% of all my local media, and IceFilms now manages all the HD/720p stuff. I admit that getting my jailbreaking going was a pain in the arse (iTunes to blame there i think..), but once the IPSW was on, a further hour, XBMC and all the supporting skins, add ons etc were in place, all previous functionality was restored.
i'd like to say a big and hearty thank you to Keith, Davilla and the host of other of other developers too numerous to mention for this fantastic software, and making a recent Apple TV owner very happy indeed. This is just the starting months of what looks to be quite a year for ATV/XBMC in this house.
