Sadly devices not utilizing those channels isn't an uncommon occurrence, and it's not just clients that have weird things going on with those channels. For example you can't even choose the DFS channels on Airport Extremes if you're specifying the channel, but it will choose them automatically if it detects issues on the other channels and you have that option chosen. I specify all the channels that my APs use after doing surveys when I first moved in.
