v17 Problem with the GUI stuck in 30 hz

I have a ASUS Z270-A Mobo with a I7 7700K (Intel 630 graphics). My Monitor is a Samsung SUHD TV. I have a dual boot system (Win-7 and Win-10). This is my living room set.  I mainly boot in Win 7 to use WMC and I use Win-10 to test and get ready to drop MCE when other media center software is ready for living room deployment. KODI is by far the closest, mainly because they embrace live TV in a solid manner (Except for the limited TV guide that is Wink). 

My issue is that while in Win-10, the KODI GUI is stuck at 30hz. I have tried resetting the resolution on both the operating system and kodi many times; the win-10 desktop is fine, but the KODI GUI just stays where it is. The only way to get back to 59 or 60 hz is to run in a windowed mode, which does not make any sense for a living room setup.
BTW, my win-7 setup on the same machine and tv works good and the gui is in 60hz and switches to 24 or 30 and 3D as needed.  Does anybody know how do I change the KODI 17.5 GUI refresh rate for my windows 10 setup? I can not find any settings anywhere that I can add or modify to force the GUI in a refresh rate of my choice. 

I also note that for my TV to switch to 3D automatically, the Kodi GUI needs to be at 60 or 59hz. If the GUI is at 24 or 30hz before the 3D movie starts, the KODI player goes to 3D but the TV does not.
