When vsync is off and sync to display is enabled the playing seems fine, no missed sync and no judders. But when vsync is enabled there are very ugly judders at random points and missed counter is increasing very fast (60000-80000 / movie). It's only happens with 23.976 and 24 fps videos with refresh rate of 23hz and 24hz.

Looks like a driver problem to me, IDirect3DDevice9::GetRasterStatus() isn't functioning correctly.

I have the latest nvidia driver 280.26 but measuring the refresh rate is not the solution if it's rounded. I turn it off. One question regarding the clock speed: when sync to display is enabled the clock speed is 100.1%. Is it normal? It's needed when the refresh rate is 24. In case of 23.976Hz the clock speed should be 100%. 24p videos are more smooth when sync to display is disabled. I think that the real refresh rate of 23Hz is 23.971, not 23.976 (it's reported by MPC-HC). How can i stop the missed counter and get the sync working?

If it helps anyone looking into this, I am having the exact same problem.
Using the current nightly I get random dropped frames. But if the OSD display is on (showing fps,etc.) there is almost zero dropped frames. I say almost because in rare instances I would see one or two. I wanted to chime in to contribute that this must not be graphics card specific as I am using an ATI HD 5450 with Windows 7 32-bit. No amount of adjustments to playback cured this issue. I have since reverted to dharma where I get absolutely zero dropped frames (aside from jumping forward or reverse).

This thread is really de-railing from my perspective (I'm the one who started it). Everyone's posting about other semi-related sync problems.
What I wanted was confirmation on my conclusion that the video sync works just fine in my case, and that the only problem is that the counter produces a false indication. I was hoping someone familiar with the intrinsics of the sync function would have something to say.

I found this thread because I have the same problem, I don't know if is a xbmc's bug or a problem on my system.
When i watch some movie (at 23.976 i think) the counter of missed frames runs ... and never stop

We'd need a lot more information to even begin to know what the issue might be. A
debug log (wiki) would be a good start.

This has happened since Dharma - Gotham nightly. New HTPC (all new hardware), New TV, Same AVR - guessing the AVR is the problem?
