In reality the trademark is simply required to show the foundation owns the name, and can be used in takedown requests if required.

It has come to my attention that the following law firms specifically market their services for domain name trademark infringement protection, your case seems to be quite straight forward in the case of the sites above, they use the word Kodi in their domain names so it's open and shut, shouldn't be too expensive:

you say shouldn't be too expensive. all those sites have to do is change domains slightly. it would be a non stop battle.

typical schneegans they removed the top bar the states the site is not official, and are back to their old games... using the Kodi name all over the site!

It's clearly designed to mislead users... all this while asking for donations and handouts... shameful profiteering!

Especially with final around the corner. That seems to be when they pander hard for donations.

Although I agree to what is being said in principal, how easy or practical is it in real terms? After all you don't see Apple for example closing down fan sites which have the word iPhone in the url.

We are not talking about fansites, we are talking about sites that hurt the brand/trademark.

Fansites support the foundation... not piggy back off the name while profiting off of illegal plugins/streams.

RI'd say a website containing the word iPhone who's main purpose is to distribute and advertise cracked app store apps would be pretty damaging to apple in reputation and financially?

Just my thoughts. Apple must chose not to bother for one reason or another.

TVA was omitted from my list because it enters the realm of more debatable trademark infringement, so it gets more difficult to enforce, whereas sites that have the word "Kodi" in their site name are open and close issues. Having the word "Kodi" in a site name is far worse than simply operating a fan site offering questionable content, from a legal perspective that is.

I'm not so sure. The word is just a word. Otherwise words like :
Apple
Windows
Hoover
Tippex
Intel
Microsoft
Would never be allowed to be used in any websites relating to the product in question.

If the site was getting enough attention then apple would shut it down... they're not going to go after every little site.

IMO a strategic strike against the sites with the most users would be beneficial, Youtube, Twitter and Web... get a follow count and start there.
