Upgrading to Win 8 has got to be a big mistake with the amount of time spent troubleshooting !
I've finished my upgrade and realise I can't pass through my movies surround sound audio to the amplifier. My system is a Dell Studio Hybrid 140g. Having read up all that I can find, it seems like I needed to install the ATI HDMI Audio Device to enable pass through but the I'm not allowed to do so when running the executable.
Any ideas ? A Second problem I needed to sort out was to make Win 8 not respond to my X10 remote so that I don't get double action with eventghost as well picking it up.

Solved
The Realtek driver from v2.71 seems to work by itself
I just need to select enable DTS, dolby etc.
The pass through then works automatically in xbmc and also the netflix app in Win 8
