If the addon came preinstalled, it would indeed be violating the trademark policy. Currently Kodi doesn't ship with any content addons preinstalled. Even shipping with something in the official repo preinstalled would be a violation of our trademark policy.
With that said, the ad you described suffers from the same problem as all the eBay ones now in failing to differentiate between Kodi itself, which is still just the player, and the addon that allows you to acquire the content.
