I don't know why you try so hard not to be helpfull. It's not a problem with his TV, it's probably something in the lines of working-as-meant-to-be. And that is because some safety measures weren't set up before.

Here is what happens:
When you are using the "play to" option, kodi sends the file to your tv and also becomes a remote control that allows you to play/pause (etc) and control the volume.
Sometimes (at least the first play to whenever I start kodi for me), it sends only the file and fails to become a remote.
But whenever it succedes, for the kodi to be able to control the volume, it syncs kodi's volume with the dlna's (aka tv) volume.

Your solution is correct, and also helped me to find where those settings were hidden, but there is a simpler one.
You can use the minus (-) and plus (+) buttons at your keybord (you don't need SHIFT, and the ones at numpad also work) to reduce kodi's volume before selecting "play to", where ever you are (viewing a video or just browsing the interface).
And you can also use them (-/+) to control your TV's audio while the video is streaming.

Also Kodi plays mkv (of course it does), your TV probably doesn't.
If kodi was meant to be used only via HDMI, then why does it support DLNA?
As for the mkv you are probably right.
Now, while I said it is probably working-as-meant-to-be, I still think it should be altered. Something like the first-time sync changes kodi's volume with tv's volume instead and revert back whenever dlna remote control stops, or seperate audio control for dlna. At least that seems to be the way bubbleupnp works.
Imagine now, using the dlna of my hometheater in the middle of the night, with kodi to play a video. Even if the police doesn't come, I'll be in a tight position, as well as my hometheater
