[Live] Partitioning starts at an offset of 3072

I just tried to upgrade my HD from 9.11 to xbmc-10.0-live but got stuck at the partioning. the partition /dev/sda1 assigned to / starts at an offset of 3072 bytes from the minimum alignment for this disk, which may lead to very poor performance.

I'm using a 1TB HD from Seagate (2.5")
It's a know error and it looks like it can be ignored

But I can do yes, no or go back. All 3 options bring me back to the partitioning menu. No way to get out of this loop

Then I tried it with LVM but got stuck with "/dec/mapper/xbmclive-root does not exist"

So I have up and went back to 9.11 what works just fine.
I'm a linux noob, anybody any suggestions ?

Would it work to install XBMC live on another HD and then copy the partition with Acronis to my 1TB HD ?

Yes, but you have to make sure that you copy also the boot sector or what ever it is called. Not sure if acronis does that if you copy only a partition. To be sure you can image the whole disk. The boot loader can of course also be re-installed.
